We strive to create consistent standards for all our users. This agreement was written in English (US). To the extent any translated version of this agreement conflicts with the English version, the English version controls. If any portion of this statement is found to be unenforceable, the remaining portion will remain in full force and effect.
This Privacy Policy describes how Yupvue collects, uses and discloses information, and what choices you have with respect to the information. This Policy applies to the Yupvue.com services (collectively, “Services”).
We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of the policy and, if the changes are significant, we will provide you with additional notice (such as adding a statement to our homepage or sending you an email notification). We encourage you to review the Privacy Policy whenever you access the Services to stay informed about our information practices and the choices available to you.
By using the Services, you accept the terms of this Policy and our Terms of Service, and consent to our initial collection, use, disclosure, and retention of your information as described in this Policy and Terms of Service.
Please note that this Policy does not apply to information collected through third-party websites or services that you may access through the Services or that you submit to us through email, text message or other electronic message or offline.

Collection of Information
Information You Provide to Us
We collect information you provide to us directly when you use the Services. This includes:

Account information: If you create a Yupvue account, we may require you to provide a username and password. Your username is public, and it doesn’t have to be related to your real name. You may also provide other account information, like an email address, bio, or profile picture. We also store your user account preferences and settings.

Content you submit and Actions you take. We collect the content you submit to the Services. This includes your posts and comments including saved drafts, videos, images, your messages with other users (e.g., private messages and chats) and your reports and other communications with users and with us. Your content may include text, links, images, gifs, and videos.

Transactional information: If you purchase services from us (e.g., rental services, subscriptions and advertisement), we will collect certain information from you, including your name, address, email address, and information about the services you are purchasing. Yupvue uses industry-standard payment processor services (for example, Stripe or square) to handle payment information.

Other information: You may choose to provide other information directly to us. For example, we may collect information when you fill out a form, participate in Yupvue -sponsored activities or promotions, apply for a job, apply for gigs and list a property on Yupvue or request customer support, or otherwise communicate with us.
Information We Collect Automatically When You Use the Services
When you access or use our Services, we automatically collect information about your use of the Services, including:

Log Information: We log information about your use of the Services, including the type of browser you use, access times, pages viewed, your IP address and the page you visited before navigating to our Services.

Device Information: We collect information about the computer or mobile device you use to access our Services, including the hardware model, operating system and version, screen resolution, color and depth, device identifiers and mobile network information.

Location Information: We may receive and process information about your location. For example, with your consent, we may collect information about the specific location of your mobile device (for example, by using GPS or Bluetooth). We may also receive location information from you when you choose to share such information on our Services, including by associating your content with a location, or we may derive your approximate location from other information about you, including your IP address.

Information collected from cookies and similar technologies: We may receive information from cookies, which are pieces of data your browser stores and sends back to us when making requests, and similar technologies. We use this information to improve your experience, understand user activity, personalize content and advertisements, and improve the quality of our Services. For example, we store and retrieve information about your preferred language and other settings.

Information We Collect from Other Sources: We may also obtain information from other sources and combine that with information we collect through our Services. For example, if you create or log into your account through a social media site, we will have access to certain information from that site, such as your name, account information and friends lists, in accordance with the authorization procedures determined by such social media site. We may receive updated information about you, such as an updated billing address, from the financial institution issuing your credit card in connection with our billing for the Services. When somebody buys a gift for you on our service, we’ll receive your shipping information from the purchaser. Users also can share another person’s email address with us through features that can invite the other person to view the user’s content.

Information Collected from Advertisers and Potential Advertisers: If you use Yupvue Ads, we collect some additional information. To sign up for Yupvue Ads, you must provide your name, email address, and information about your company. If you purchase advertising services, you will need to provide transactional information as described above, and we may also require additional documentation to verify your identity. When using Yupvue Ads, we may record a session replay of your visit for customer service, troubleshooting, and usability research purposes.

EXIF Data: Exchangeable Image File Format (“EXIF”) data is a record of the settings and other relevant metadata inserted by a digital camera when you take a photo or video such as camera type, aperture, shutter speed, focal length, and location (as described above), among other information. Unless you turn off EXIF data on your camera or device or remove it from the picture before uploading to Yupvue – Yupvue receives and stores EXIF data.
We Use Information About You To

Help protect the safety of Yupvue and our users, which includes blocking suspected spammers, addressing abuse, and enforcing the Yupvue Term of Use Agreement and our other policies;

Communicate with you about products, services, offers, promotions, and events, and provide other news and information we think will be of interest to you;

Sharing of Personal Information
We do not share or sell the personal information that you provide us with other organizations without your express consent, except as described in this Privacy Policy. We disclose personal information to third parties under the following circumstances:

Affiliates. We may disclose your personal information to our subsidiaries and corporate affiliates for purposes consistent with this Privacy Policy.

Business Transfers. We may share personal information when we do a business deal, or negotiate a business deal, involving the sale or transfer of all or a part of our business or assets. These deals can include any merger, financing, acquisition, or bankruptcy transaction or proceeding.

Social Sharing Features and Third-Party Integrations
The Services may offer social sharing features and other integrated tools which let you share actions you take on our Services with other media, and vice versa. The use of such features enables the sharing of information with your friends, the public, and others, depending on the settings you establish with the entity that provides the social sharing feature, and depending on that entity’s other sharing practices. Additionally, you may give certain third-party apps different levels of permissions to interact with your account to take advantage of things like view content, videos and images. If you want to stop using one of these apps and revoke your permission, click the "Cancel Permission" under sharing on your account.
Data Transfers
We are based in the United States, and we process and store information on servers located in the United States. We may store information on servers and equipment in other countries depending on a variety of factors, including the locations of our users and service providers. By accessing or using the Services or otherwise providing information to us, you consent to the processing, transfer, and storage of information in and to the U.S. and other countries, where you may not have the same rights as you do under local law.
In connection with Yupvue's processing of personal data received from the European Union, Switzerland, and the United Kingdom, we adhere to the EU-U.S. and Swiss-U.S. Privacy Shield Program (“Privacy Shield”) and comply with its framework and principles. Although the EU-U.S. Privacy Shield Program may no longer be a valid basis for certain international data transfers, Yupvue continues to comply with the Privacy Shield framework and principles with respect to personal data received from the EU in addition to all other applicable laws.
Please direct any inquiries or complaints regarding our compliance with the Privacy Shield principles to the point of contact listed in the “Contact Us” section below. If we do not resolve your complaint, you may submit your complaint free of charge to JAMS. Under certain conditions specified by the Privacy Shield principles, you may also be able to invoke binding arbitration to resolve your complaint. We are subject to the investigatory and enforcement powers of the Federal Trade Commission. In certain circumstances, we may be liable for the transfer of personal data from the EU, Switzerland, or the UK to a third party outside those countries.

Your Choices
Our goal is to give you simple and meaningful choices regarding your information. If you have a Yupvue account, many of these controls are built directly into Yupvue or your settings. For example, you can:

Edit information in your profile at any time, decide whether your profile is available to search engines, or choose whether others can find your Yupvue account using your email address.

Link or unlink your Yupvue account from other services (like Facebook, Google or Twitter). For some services (like Facebook), you can also decide whether or not to publish your Yupvue activity to that service.

Choose whether Yupvue will be customized for you using information from other websites or apps. If you have a Yupvue account and want to control how your offsite data is used to tailor your experience, you can visit your settings and update your “Personalization” preferences.

Choose whether Yupvue ads delivered to you on other platforms, sites or apps are customized using information about your account activities. You can control this by visiting and updating your “Personalization” preferences.

Choose whether Yupvue shares information about your activity on Yupvue for ads performance reporting. You can control this by visiting and updating your “Personalization” preferences.

Close your account at any time. When you close your account, we’ll deactivate it, remove and delete your account data. Please note that there may be legal reasons for us to keep your data, such as if we receive a law enforcement request asking us to preserve data. We may also retain certain information in our backup systems for a limited period of time, or as required by law.

You also have choices available to you through the device or software you use to access Yupvue. For example: The browser you use lets you control cookies or other types of local data storage. Your mobile device lets you choose how and whether your precise location, photos, contacts and other data is shared with us.
Your Rights
Data Subject and Consumer Information Requests
Requests for a copy of the information Yupvue has about your account—including EU General Data Protection Regulation (GDPR) data subject access requests and California Consumer Privacy Act (CCPA) consumer information requests—can be submitted via email to Gpolicy@yupvue.com from the email address that you have verified with your Yupvue account.
Before we process a request from you about your personal information, we need to verify the request via your access to your Yupvue account or to a verified email address associated with your Yupvue account. You may also designate an authorized agent to exercise these rights on your behalf. Yupvue does not discriminate against users for exercising their rights under data protection laws to make requests regarding their personal information.
How Information is Secured
We retain information we collect as long as it is necessary and relevant to fulfill the purposes outlined in this privacy policy. In addition, we retain personal information to comply with applicable law where required, prevent fraud, resolve disputes, troubleshoot problems, assist with any investigation, enforce our Terms of Service, and other actions permitted by law.
To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.
In some circumstances we may anonymize your personal information (so that it can no longer be associated with you) in which case we may use this information indefinitely without further notice to you.
We employ industry standard security measures designed to protect the security of all information submitted through the Services. However, the security of information transmitted through the internet can never be guaranteed. We are not responsible for any interception or interruption of any communications through the internet or for changes to or losses of data. Users of the Services are responsible for maintaining the security of any password, user ID or other form of authentication involved in obtaining access to password protected or secure areas of any of our digital services.
Additional Information for EEA Users
Users in the European Economic Area have the right to request access to, rectification of, or erasure of their personal data; to data portability in certain circumstances; to request restriction of processing; to object to processing; and to withdraw consent for processing where they have previously provided consent. These rights can be exercised using the information provided under “Your Choices” above or as described in the “Your Rights - Data Subject and Consumer Information Requests section” above. EEA users also have the right to lodge a complaint with their local supervisory authority.
As required by applicable law, we collect and process information about individuals in the EEA only where we have a legal basis for doing so. Our legal bases depend on the Services you use and how you use them. We process your information on the following legal bases:

If you are a California resident, you have additional rights under the CCPA, including the right to request access to or deletion of your personal information, and information about our data practices, as well as the right not to be discriminated against for exercising your privacy rights. These rights can be exercised as described in the Data Subject and Consumer Information Requests section above.
Children
Children under the age of 13 are not allowed to create an account or otherwise use the Services. Additionally, if you are in the EEA, you must be over the age required by the laws of your country to create an account or otherwise use the Services, or we need to have obtained verifiable consent from your parent or legal guardian.
Changes to This Policy
We may change this Privacy Policy from time to time. If we do, we will let you know by revising the date at the top of the policy. If the changes, in our sole discretion, are material, we may also notify you by sending an email to the address associated with your account (if you have chosen to provide an email address) or by otherwise providing notice through our Services. We encourage you to review the Privacy Policy whenever you access or use our Services or otherwise interact with us to stay informed about our information practices and the ways you can help protect your privacy. By continuing to use our Services after Privacy Policy changes go into effect, you agree to be bound by the revised policy.
